CalArts submitted its brief to the arbitrator for the supervisory challenge, which included the submission of evidence in the form of witness declarations and documents, including personnel files (as is standard in such litigation). In an attempt to keep personnel files and personnel documents confidential, CalArts contacted CU-UAW’s attorney to obtain an agreement that the personnel files included as evidence by either side would be kept confidential, for litigation purposes only; however, that request was denied.
